They stated that my monthly payments and interest rates would be a certain amount&#8230; but the numbers kept changing and increasing&#8230; Three days after the closing, I received a new set of papers the same as the ones I&#8217;d signed at the closing&#8230; but the closing cost numbers had been increased by 000 And there was a post it note attached requesting that I back date my signature!! Because I refused to sign the new set of closing papers and agree to an additional 000, Guardian Loan Company did not disburse the funds to my mortgage company. Shortly thereafter, my mortgage was assigned to a bank&#8230; Wells Fargo. Shortly thereafter, Wells Fargo notified me that they would be increasing my mortgage payments. And, though it was difficult, I managed to maintain the payments. Then, in, 2006, I received a letter from Wells Fargo stating that there were delinquent payments&#8230; I knew this was a mistake and had the receipts to prove it. Nevertheless, in December 2006, I received a Notice of Default (NOD). The bank returned both November&#8217;s and December&#8217;s mortgage payments and started foreclosure proceedings against me. <p>Here is a proposed solution for homeowners facing foreclosure in the non-judicial foreclosure states, such as California, Nevada, New Mexico, Massachusetts, New Hampshire, where the bank does not go into court to foreclose. My group lawsuit, to have aggrieved homeowners gang up on the errant banks (and provide an extra bang for the homeowner&#8217;s buck), gives aggrieved homeowners access to the courts to fight foreclosure by reducing the costs of access (including the dollar costs and attorney time charges per homeowner); it creates a greater probability that some of the banks would rather give a modification agreement than remain in the huge lawsuit; it gives a vehicle for aggrieved homeowners to get massive publicity about their plight; and it may bring to the attention of state legislators that the state should adopt foreclosure statutes similar to New York State as a way of reducing the impact of the banks predatory activities and preventing the banks (in many cases) from obtaining the full amount of their usurious interest and fees. <p>We are coming up on the one year anniversary that Commercial Bank of Texas illegally foreclosed on my Family. Serah, our twelve year old daughter, filmed this illegal foreclosure sale on September 1, 2009.This is a clip from her video. This story will not die. My Family is still homeless due to the illegal eviction by the Nacogdoches County Sheriff&#8217;s Department on January 12, 2010. They also STOLE all our personal property and pets and placed the property in McDonald&#8217;s storage buildings that were rented by Nacogdoches County Sheriff Chief Deputy Doug Richardson. This is stolen property. Among the property is our Family&#8217;s complete collection of pictures of our daughters growing up and our Family. There are also Baby books with their footprints, Christening Gowns, and other items that are irreplaceable. My wife&#8217;s wedding gown and portrait were at home when the sheriff&#8217;s department brought INMATES in to steal this property. If ANY of this property is missing or damaged, there is not a remedy for such a loss. I believe most people can understand my feelings on this. As you watch this video, listen to when I ask if mineral rights were included in the sale and hear how the attorney for Commercial Bank of Texas, Tom Belanger, answers. When a bank forecloses on a home, RARELY do they receive a bid high enough to pay off the debt. Most banks will do everything they can to get as much of their money back as they can. Doesn&#8217;t that make sense? Then why did Tom Belanger answer my <b>&#8230;</b></p>
